Terms and Conditions for AE Electrical (2008) Limited Network Services
1. These Terms
1.1 These terms and conditions set out the basis on which AE Electrical (2008) Limited provides a local network connection through our private network to residential and business customers. By applying for and using our Services, you agree to these terms.
1.2 Additional terms may apply to certain Services. If so, we will inform you of those terms. If there is any conflict between these terms and additional terms, the additional terms will prevail.
2. Our Services
2.1 We are not obliged to provide Services unless we accept your application. Acceptance of your application is at our discretion, and the availability of a Service cannot be guaranteed until it is connected.
2.2 We will use all reasonable efforts to make our network available at all times. However, as our network relies on services owned by other providers, we cannot guarantee uninterrupted availability. In the event of a disruption, we will endeavor to restore services as quickly as possible.
2.3 We may suspend or restrict access to our network if reasonably necessary to protect or maintain its functionality. We will attempt to notify you in advance but cannot guarantee prior notice in all circumstances.
3. Charges
3.1 You are responsible for paying all charges associated with the network services we provide, regardless of whether you or someone else uses the connection. You are also responsible for maintaining your equipment and network devices.
3.2 Payments must be made by the Due Date specified on your invoice. If payment is not received by the Due Date, we reserve the right to suspend or restrict your connection after providing a 7-day grace period and reasonable attempts to contact you.
4. Fair Use
4.1 Our network is subject to a Fair Use Policy to ensure all customers enjoy reliable service.
4.2 Your use of the network must be fair, reasonable, and not excessive. Excessive usage is determined by comparing your usage to the average bandwidth consumption of typical customers on your plan, measured over a daily, weekly, or monthly period.
4.3 If we determine, at our discretion, that your usage is unfair, unreasonable, or excessive, we may suspend, modify, or restrict your use of the Services without notice.
5. Fixed Contracts and Termination
5.1 For fixed contracts, an early termination fee of $450.00 applies if you cancel the service before the end of the 12-month term. A 1-month written notice is required for disconnection. If cancellation occurs during this notice period, the early termination fee will still apply, in addition to any charges for the final month of service.
5.2 If you choose to disconnect at the end of your fixed contract term, you must provide at least 1-month written notice.
6. Installation and Equipment
6.1 Installation involves a visit from one of our technicians, who will mount a wireless dish on your roof and run a data cable to your modem. We can provide a new modem or connect to your existing one if compatible.
6.2 You are responsible for maintaining your equipment and ensuring it remains functional. Any damage to or malfunction of customer-owned equipment is not the responsibility of AE Electrical (2008) Limited.
